Patent Application Notes

FAQ

What is a patent?

1. The patentee enjoys exclusive rights to his or her invention within the time limit prescribed by law. 2. A patent is an intellectual property right that can be exchanged, inherited, transferred, etc. during its validity period.

What types of patent applications are there in China?

There are roughly three types of patent applications that can be filed in China: invention patents, utility model patents, and design patents.

Why apply for a patent?

Applying for a patent can protect one's own inventions from being copied by others, while at the same time monopolizing the market for new technologies and products and obtaining corresponding economic benefits (e.g., by profiting through the production and sale of patented products, the transfer of patented technology, patent implementation licenses, and patent equity investments). Any technology that is publicly disclosed without patent protection can be used free of charge by any entity or individual.

What is the difference between a utility model and an invention patent?

Compared to inventions, their biggest commonality is that they both belong to technical solutions, and in some cases, inventions and utility models can be converted into each other. Therefore, the methods of protection are basically the same, but there are still significant differences between the two: First, the scope of protection is different; second, the creativity requirements for utility model patents are lower than those for invention patents; third, the examination procedures for utility model patents are simpler and faster than those for invention patents; and fourth, the protection periods are different.

What is patent priority?

Definition of patent priority: When a patent applicant files a patent application for an invention for the first time in a country and then files a patent application for the same subject matter within the statutory time limit, the subsequent application is deemed to have the date of the first patent application as its filing date, in accordance with the relevant laws. This right enjoyed by the patent applicant is called priority right.

What is the Patent Cooperation Treaty (PCT)?

PCT is the abbreviation for the Patent Cooperation Treaty, an international treaty related to patents. Under the PCT, patent applicants can file international patent applications through the PCT system and apply for patents in multiple countries. This means that applicants can submit an international application in one language to the international receiving office and obtain patent protection in multiple PCT member countries, which greatly simplifies the process of applying for patents abroad.

What are the five documents referred to in patents?

Description, description drawings, claims, abstract of the description, and abstract drawings.

What is patent infringement?

Patent infringement refers to the act of exploiting a patent without the permission of the patent owner (i.e., manufacturing, using, selling, offering for sale, or importing a patented product or a product directly obtained by a patented method for production and business purposes).
