Copyright Registration Considerations
FAQ
What is copyright?
Copyright is also a part of the legitimate intellectual property rights of copyright owners. In China, copyright is commonly referred to as copyright. Simply put, copyright is the right to copy. This means that the original creators of a product and anyone they authorize are the only ones who have the right to copy it. Copyright is a legal term used to describe the rights that creators have over their literary and artistic works.
What types of copyright are there?
1. Written works; 2. Oral works; 3. Musical, theatrical, quyi, dance, and acrobatic works; 4. Fine arts and architectural works; 5. Photographic works; 6. Cinematic works and works created by a process similar to cinematography; 7. Graphic works and model works such as engineering drawings, product design drawings, maps, and diagrams; 8. Computer software; 9. Other works as prescribed by laws and administrative regulations.
How is copyright acquired?
There are two ways to acquire copyright: 1. Automatic acquisition: In China, according to the Copyright Law, the author automatically enjoys copyright upon completion of the work, regardless of whether it is published or not. 2. Registration acquisition: According to the relevant provisions of the Measures for Voluntary Registration of Works issued by the National Copyright Administration, any author, other citizens, legal persons, non-legal persons, or units enjoying copyright, as well as exclusive right owners and their agents, may apply for work registration.
How long does copyright generally last?
The World Copyright Convention initiated by UNESCO stipulates that 'the term of copyright protection shall be no less than 25 years from the date of publication.' The regulations vary from country to country. China stipulates a protection period of 50 years after the applicant's death, while the United States stipulates 70 years.
What does copyright protection cover?
Copyright protects the form of expression of ideas, not the ideas themselves, because in protecting copyright property rights, such exclusive private property rights and interests, it is also necessary to take into account the accumulation of human civilization and the dissemination of knowledge and information. Therefore, algorithms, mathematical methods, technology or machine designs are not objects that copyright is intended to protect.
How long does copyright registration take?
Generally, the time required for copyright registration of a work is calculated from the date the registration authority accepts the registration application, and the processing department must complete it within 30 working days. However, the time required for processing varies depending on each person's actual situation.
